{"id":26429,"date":"2021-07-28T18:41:03","date_gmt":"2021-07-28T18:41:03","guid":{"rendered":"https:\/\/www.kumasionlinegh.com\/?p=26429"},"modified":"2021-07-28T19:16:43","modified_gmt":"2021-07-28T19:16:43","slug":"assin-north-ndcs-gyakye-quayson-in-trouble-again-as-npp-secretary-files-criminal-case","status":"publish","type":"post","link":"https:\/\/www.kumasionlinetv.com\/?p=26429","title":{"rendered":"Assin North: NDC\u2019s Gyakye Quayson in trouble again as NPP secretary files criminal case"},"content":{"rendered":"\n<p>It appears more trouble is brewing for the embattled NDC Member of Parliament for Assin North, Joe Gyakye Quayson, after the High Court in Cape Coast declared the polls that elected him in the 2020 parliamentary election as null and void.<\/p>\n\n\n\n<p>After losing the case against the petitioner, Michael Ankumah Nimfa, the Central Regional Secretary of the governing New Patriotic Party and spokesperson of the petitioner, Richard Takyi Mensah, has in his personal capacity also filed a fresh criminal case against Mr. Gyakye Quayson, who can no longer hold himself as the MP for Assin North.<\/p>\n\n\n\n<p>The complaint filed at the Criminal Investigations Department (CID) of the Ghana Police Service is to investigate his participation in a number of unlawful activities, including his participation in the election of the Speaker of Parliament, although the High Court had&nbsp;<strong><a href=\"https:\/\/citinewsroom.com\/2021\/01\/injuncted-assin-north-mp-elect-prevented-from-selecting-speaker-of-parliament\/\">barred Mr. Quayson<\/a><\/strong>&nbsp;from holding himself as an MP at the time.<\/p>\n\n\n\n<p>Speaking to&nbsp;<strong>Citi News<\/strong>&nbsp;shortly after Wednesday\u2019s ruling, Henry Nana Boakye, who is the governing New Patriotic Party\u2019s Youth Organizer and lawyer for the main petitioner in the dual citizenship case, said the outcome of the main case is welcoming.<\/p>\n\n\n\n<p>\u201cToday\u2019s [Wednesday, July, 28, 2021] judgement is an endorsement of our position that his election and even filing of nomination is in contravention of Article 94(2) of the constitution and also, section 9.2 of the Representation of People\u2019s Act, PNDC Law 284, and prayed the court declared it illegal, null and void, and today [Wednesday] the court endorsed this position and ruled in favour of that position.\u201d<\/p>\n\n\n\n<p>But he quickly added that his side is also collaborating with the CID to have further charges pressed against the MP for engaging in other illegalities.<\/p>\n\n\n\n<p>\u201cOur Regional Secretary has made a formal complaint to the CID, so I am very sure that the CID in its judgement will consider it and critically assess it, and we\u2019re also going on with the criminal proceedings. The laws have not changed regarding filing nominations and dual citizenship, so we are looking forward to the law taking effect. Don\u2019t forget that before the swearing-in there was an injunction against him for holding himself up as an MP, and I am very sure that criminal charges will be pressed against him,\u201d he said.<\/p>\n\n\n\n<p><strong>Details of complaint<\/strong><\/p>\n\n\n\n<p>In the separate petition to the CID and sighted by&nbsp;citinewsroom.com&nbsp;Mr. Takyi Mensah argued that the MP appended his signature before a judicial officer that he did not owe allegiance to any country other than Ghana, at the time when he was fully aware that as a matter of fact, he owed allegiance to Canada at that material time of making the said statutory declaration.<\/p>\n\n\n\n<p>He also makes the point that the MP in his quest to acquire a Ghanaian passport on July 30, 2019, was asked whether he held dual citizenship, but he answered in the negative when in fact at the time of filling the said Ghanaian passport application forms, he was holding on to the Canadian Citizenship.<\/p>\n\n\n\n<p>In this regard, he insisted that Mr. James Gyake Quayson has perjured himself by lying under oath hence,&nbsp; \u201cthe petition for criminal investigations to be conducted.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Background<\/strong><\/h4>\n\n\n\n<p>The Cape Coast High Court in the Central Region has declared the 2020 parliamentary election held in the Assin North Constituency as null and void.<\/p>\n\n\n\n<p>The court has therefore ordered for a&nbsp;<a href=\"https:\/\/citinewsroom.com\/2021\/07\/court-cancels-2020-assin-north-parliamentary-election-orders-for-fresh-polls\/\"><strong>fresh election to be conducted in the constituency<\/strong><\/a>.<\/p>\n\n\n\n<p>This ruling was given on Wednesday, July 28, 2021, by the court presided over by Justice Kwasi Boakye.<\/p>\n\n\n\n<p>In his judgement, Justice Boakye upheld that, the National Democratic Congress\u2019 2020 parliamentary candidate for the constituency, Joe Gyakye Quayson breached the provisions of the constitution with regard to dual citizenship.<\/p>\n\n\n\n<p>The ruling means that the NDC\u2019s seats in Parliament have dropped to 136 as against the NPP\u2019s 137 until a by-election is held to determine who wins the seat.<\/p>\n\n\n\n<p>After he was declared winner in the constituency\u2019s election, Mr. Quayson was dragged to court by&nbsp;<strong><a href=\"https:\/\/citinewsroom.com\/2021\/01\/cid-petitioned-to-investigate-assin-north-mp-over-alleged-dual-citizenship\/\">Michael Ankomah-Nimfa,<\/a><\/strong>&nbsp;a resident of Assin Bereku in the Central Region.<\/p>\n\n\n\n<p>Mr. Akomah-Ninfa filed a petition at the Cape Coast High Court seeking to annul the declaration of Mr. James Gyakye Quayson as the Member of Parliament for the Assin North Constituency for owing allegiance to Canada.<\/p>\n\n\n\n<p>In November last year, a group calling itself \u2018Concerned Citizens of Assin North\u2019 petitioned the Electoral Commission in the Central Region to withdraw the candidature of Mr. Quayson, arguing that he owes allegiance to Canada.<\/p>\n\n\n\n<p>According to&nbsp;Article 94 (2) (a) of the 1992 constitution of Ghana, \u201cA person shall not be qualified to be a member of Parliament if he or she \u2013 (a) owes allegiance to a country other than Ghana.\u201d<\/p>\n\n\n\n<p>The National Democratic Congress (NDC), had insisted that their MP is \u201ca full citizen of Ghana who owes no allegiance whatsoever to any other country.
