{"id":36461,"date":"2022-03-09T09:07:29","date_gmt":"2022-03-09T09:07:29","guid":{"rendered":"https:\/\/www.kumasionlinegh.com\/?p=36461"},"modified":"2022-03-09T09:07:30","modified_gmt":"2022-03-09T09:07:30","slug":"supreme-court-dismisses-preliminary-objections-to-substituted-service-on-assin-north-mp","status":"publish","type":"post","link":"https:\/\/www.kumasionlinetv.com\/?p=36461","title":{"rendered":"Supreme Court dismisses preliminary objections to substituted service on Assin North MP"},"content":{"rendered":"\n<p><a href=\"https:\/\/citinewsroom.com\/2022\/03\/supreme-court-dismisses-preliminary-objections-to-substituted-service-on-assin-north-mp\/#\"><\/a>The Supreme Court on Tuesday dismissed preliminary objections to its ordered substituted service of the processes and notice of hearing in the case challenging the continuous stay in office of James Gyakye Quayson as Assin North Member of Parliament.<\/p>\n\n\n\n<p>The apex court subsequently ordered James Gyakye Quayson to file his responses to the processes against him on or before Wednesday, March 16, 2022.<\/p>\n\n\n\n<p>The Supreme Court at the last adjourned date ordered substituted service of the processes on the embattled Member of Parliament, on whom the applicant had made several failed attempts to serve the processes.<\/p>\n\n\n\n<p>The plaintiff was to post copies of the process on the notice boards of the Supreme Court and on the High Court in Assin Fosu. In addition, he was also to cause a publication of same in the Daily Graphic Newspaper.<\/p>\n\n\n\n<p>Mr. Tsatsu Tsikata, lawyer for the disputed Member of Parliament, however, argued in Court that two publications were caused in the \u201cDaily Graphic\u201d Newspaper but that the publications fell short of the orders of the Court.<\/p>\n\n\n\n<p>He contended that the publications, made on February 26, and March 1, 2022, only contained the order for a substituted service, plus a hearing notice to the parties, but, without the processes to be responded to.<\/p>\n\n\n\n<p>He also argued that the writ was not mature for hearing, since the hearing notice specifically stipulated a 7-day maturation period upon publication.<\/p>\n\n\n\n<p>Admitting what he said was an inadvertent error in the first \u201cDaily Graphic\u201d publication of February 26, Frank Davis for the plaintiff however told the Court that they did \u201cexactly as the Court directed\u201d<\/p>\n\n\n\n<p>He contended that \u201cthere were three other modes of substituted service\u201d and that \u201cthe other modes of service have put him (the defendant) in notice enough for this hearing\u201d.<\/p>\n\n\n\n<p>The Court also found that Mr. Justine Teriwajah, on the record for Mr. Quayson, had previously written to the Court Registrar \u201cupon execution of the substituted service\u201d order seeking to be furnished with the processes. This request, the Registrar told the Court, had been duly met.<\/p>\n\n\n\n<p>While the Attorney-General told the Court that Mr. Teriwajah\u2019s letter which he \u201cwrote in good faith settled the matter\u201d, Mr. Tsikata insisted that \u201cthis is a situation of genuine confusion that has been created\u201d.<\/p>\n\n\n\n<p>President of the Court, Dotse JSC, in reading the decision of the Court, said \u201cthe essence of substituted service was to bring to the attention of a party of a pendency of a suit\u201d; and, that in making its order for substituted service including a newspaper publication, \u201cthis Court does not expect all processes to be published\u201d.<\/p>\n\n\n\n<p>Also, holding that Justine Teriwajah\u2019s letter to the Court Registrar \u201cspeaks for itself\u201d, the Court dismissed the objection.<\/p>\n\n\n\n<p>On the question of whether the writ had matured for hearing as per the hearing notice issued with the order for substituted service, the \u201cCourt in a majority decision of 6:1, with Kulendi JSC dissenting, holds that the 1st Defendant was duly served as at 28th February 2022.<\/p>\n\n\n\n<p>The case has been adjourned to Wednesday, March 16, 2022.<\/p>\n\n\n\n<p><strong>Panel<\/strong><br>His Lordship Jones Dotse as President<br>Her Ladyship Agnes Dordzie<br>His Lordship Nene Amegatcher<br>Her Ladyship Mariama Owusu<br>Her Ladyship Getrude Torkornoo<br>Her Ladyship Prof. Henrietta Mensah Bonsu<br>His Lordship Yuoni Kulendi<\/p>\n\n\n\n<p><strong>Send your news stories to\u00a0<a href=\"mailto:dannyboy744@gmail.com\">dannyboy744@gmail.com<\/a>\u00a0and via WhatsApp on +233 26677777<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on Tuesday dismissed preliminary objections to its ordered substituted service of the processes and notice of hearing in the case challenging the continuous stay in office of James Gyakye Quayson as Assin North Member of Parliament.
